NC Color Run Waiver & Release of all Claims and Assumption of Risk (the “Waiver”)

I recognize and acknowledge that my participation in the NC Color Run (the "Run") involves the risks, both foreseen and unforeseen, of physical injury, death, or property damage.  I voluntarily and knowingly agree to assume all the risks of injuries, damages or losses, regardless of severity, that I may sustain as a result of said participation, including, but not limited to, slips, falls, contact with other participants, race officials, agents, volunteers, sponsors or spectators, any defects or condition of roads, traffic, altitude, and the effects of the weather, including ice, rain, snow, storms, high heat and/or humidity.  I further agree to waive and relinquish all claims I may have (or which may accrue to me) as a result of participating in the Run, including but not limited to claims against the race officials, agents, volunteers, sponsors, and the owners or operators of the venue (collectively, “Administrators”).

I will not enter and participate in the Run unless I am medically able, in good health, and properly trained.  I acknowledge that it is my responsibility to consult a physician before participating in the Run, particularly if I am pregnant, disabled in any way, or have recently suffered an illness, injury, or impairment.  I understand that the Administrators do not maintain medical, health, or disability insurance coverage for the participants and that I am expected and encouraged to obtain my own medical or health coverage.  I consent to receive medical treatment that may be deemed advisable or necessary in the event of injury, accident, or illness before, during, or after the Run resulting from my participation.

I, for myself, my heirs, and anyone entitled to act on my behalf, do hereby fully release and forever discharge the Administrators from any and all claims and liabilities for injuries, including death or incapacity, illnesses, damages, expenses, or loss that I may suffer arising out of, connected with, or in any way associated with the Run, program, activities, or transportation to and from the event, even though that liability may arise out of negligence or carelessness on the part of the Administrators.  I further agree to hold harmless and indemnify the Administrators from any and all claims caused in whole or in part by my actions or inactions.

I also grant permission to all the foregoing to use any photographs, motion pictures, recordings, or any other record of the event for any legitimate purpose, including but not limited to news coverage of the Run and promotional materials for the run.

I have read and fully understand the above information, warning of risk, assumption of risk and waiver and release of all claims.

When registering online, my online agreement shall substitute for and have the same legal effect as an original form signature.  I acknowledge that participation will be denied if I have not accepted this Waiver before the start of the event.
